Terms & Conditions

These terms and conditions form the basis of the contract between our customers and Confectionery and Training. These terms and your order confirmation is, to set out the agreement between you and us for the sale of cakes/training courses. It is your responsibility to check all details on the order form are complete and accurate.

Basis of sale

Any samples, drawings or descriptions we issue and descriptions or illustrations contained on our website and social media are issued to provide you with an approximate idea of the cakes/training they describe and remain the property of Confectionery and Training.

Quotes on cakes are valid for a period of 14 days from the date given. Cake sizes are in inches and based on the diameter of the cake. Cakes are 3.5-4 inches deep. If you wish to purchase a deeper cake you need to request this when booking.

No contract is made until we receive your deposit. Once your deposit has been received you are in a legally binding contract with Confectionery and Training.

Cakes

We warrant that on delivery or collection the cakes shall conform to their description as set out on the order form, are of satisfactory quality and comply with all food safety, statutory & regulatory requirements in the UK. We will not be held responsible for customer disappointment of the design or interpretation of the cake as long as it is made in line with the customers requirements as set out on the order form and will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation and or drawing is correct and meet their exact requirements.

The warrant does not apply to any defect in the cakes arising from wilful damage, accident, negligence by you or any third party, if you use the cake in any way we don’t recommend, your failure to follow our instructions or any alterations you carry out.

Our cakes are made in an environment where allergens are used including nuts, eggs, wheat, milk and others. We can cater for allergies egg, dairy and gluten but unfortunately not nut free.

We cannot guarantee an exact replica of any cake you show us but it will be similar to this. Where colour swatches are provided, we will match as close as possible. Fresh flowers will be an extra cost added to a cake. Some flowers are toxic and are not suitable to be used on cakes. We suggest you ask your florist for details on this regarding toxicity.

If your cake contains hand made models made from sugar paste or gum paste, we do not recommend that they be eaten due to the presence of dowels/toothpicks used for reinforcement. All our figures are hand made and while we capture the characteristics of a particular person if requested (eye colour, hair, glasses etc) we cannot guarantee a true likeness.

It is your responsibility to provide images for references and the image needs to be provided no later than 4 weeks prior to the event.

All cakes are fresh and contain no additives or preservatives and it is advised to assume consumption is by the best before date given. Cakes should be stored in a dry location at room temperature, away from direct sunlight or a heat source. They should NOT be refrigerated. Confectionery and Training and the customer expressly agree that the cakes and all goods purchased from Confectionery and Training remain the property of Confectionery and Training until paid in full.

Delivery and Collection

All orders may be collected from Confectionery and Training by prior agreement. We accept no responsibility for any damage sustained to the cake once it has left the premises. We advise the cake is put in the boot of the car or in the front footwell with the seat back, once collected and not on the seat of a car or on a person’s lap as this could cause damage to the cake.

If delivery has been requested, we will deliver the cake on the day as confirmed on the order form. You will be contacted prior to arrange a delivery time. If the delivery address changes after the order  

have been confirmed additional charges may be added to cover extra milage.

When delivering to a wedding venue, we will contact the venue in advance to arrange a delivery time. If we set up the wedding cake, we will take photograph before leaving the venue and obtain a signature from the venue confirming the cake has been received in good condition. If the venue wants to set the cake up themselves, we will explain how the cake is to be displayed and obtain a signature to verify we have done so. Once the cake has been delivered, we are unable to accept any liability for any damage sustained to the cake thereafter. If the cake is delivered with a cake stand a deposit will be required with the final balance of the cake. The stand must be returned to us within 3 days of the wedding. When the stand is returned the deposit will be refunded via bank transfer within 5 working days. If the stand is damaged or broken the deposit will not be returned.

Price and payment

The price of your cake will be set out on the order form. No vat is payable on any cakes. A 25% deposit is needed for wedding cakes and £20 deposit for all other cakes. A detailed order form for wedding cakes will be issued detailing final balance and payment details. No further payment reminders will be issued and it is the responsibility of the client to ensure the payment is on time.

Please not all deposits are non-refundable.

The balance must be paid on later than the date shown on the order form by bank transfer to the account specified. If debit credit card is used please allow for 3 working days for the payment to clear. If the payment is not received by the date specified this shall be constituted as a breech of contact by the client. We reserve the right to hold the order until the payment is made in full. If the payment is late, we accept no responsibility should we be unable to purchase the required stock, equipment to make the cake as required on the order form. In these circumstances the cake will be made as close to the order confirmation as possible.

Cancellations, postponements & alterations

In the event of a cancellation by yourselves charges are as follows: –

90 days to 1 calendar month prior to the date deposit and half the remaining cost

Less than 1 calendar month prior to the date full amount

Any booking fees previously paid are non-refundable.

In the event of a wedding postponement the payment due remains the same as a cancellation. If you postpone within 90 days of the wedding half the remaining cost will be due on the original payment date. If you postpone less than 1 month prior to the wedding the outstanding balance remains payable on the original due date. Subject to availability we will carry forward the money paid to the new wedding date. Any further postponement unless in exceptional circumstances will be classed as a cancellation. Postponements may be subject to an increase in costs, in line with annual cost of inflation depending on the duration of the postponement. You may prior to 8 weeks before the wedding day or 10 days for celebration cakes amend the order by providing us with written notice, in this case a new order form will be issued detailing the changes made and the new cost. Alterations are not confirmed until a new order form has been issued. If you make changes after the time scale stipulated above there will not be a reduction in the price you pay, even if your new design changed is cheaper than the original booking. If for any reason you fail to collect your cake order we reserve the right to take action to recover any balances outstanding. Confectionery and Training reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of farce, majeure including (without prejudice to the generality of the foregoing) fire, flood, storm, plant breakdown, strike, lockouts, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Confectionery and Training. In this situation we will provide you with written notice and any booking fees paid are non-refundable and we refer to our cancellation policy. As such we advise you purchase wedding insurance.

Confectionery and Training (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect there of granting a refund or other compensatory measures as Confectionery and Training, at its discretion, considers appropriate in the circumstances  

and shall be limited to the value of the goods or services given rise to the claim.

Confectionery and Training shall not under any circumstances be liable for the customers respect of indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict Confectionery and Training statutory liability for death or personal injury arising from any negligence on Confectionery and Training company’s part in liability imposed by statutory implied terms in consumer contracts.

Complaints

Complaints are very rare and due to the amount of work we put into each individual cake we take them very seriously. Any issues must be brought to our attention within 48 hours of collection or delivery to give a fair opportunity to assess the nature of the complaint. Both parties agree not to post any negative information about the other arising out of this contract or event on any online forum or website without providing advance written notice of the intended content there of and providing the other party with a prior opportunity to resolve any issues between the parties amicably. Complaints regarding the decoration of celebration cakes can be easily repaired so errors of this nature must be pointed out on collection or delivery to give us the opportunity to correct them. Once payment has been made this confirms that decoration is as requested and no further claims can be made.

Wedding cake clients will be sent a detailed drawing of the wedding cake prior to the wedding. It is the clients, responsibility to check that this meets with their requirements and raising any issues with us if there are any discrepancies. If the complaint is in regard to the quality of the cake, then it must be returned to us as soon as possible within 48 hours of collection or delivery to ensure we are able to fairy assess the nature of this complaint. We are only able to deal with the client who placed the order.

Sugar craft/food safety classes

Classes will be held at the venue advertised unless otherwise advised by us. We hold the right, if limited numbers are booked to change the venue. You will be entitled to a refund if the venue change does not suit you. Class times are on our website and will be confirmed at the time of booking. 

Bookings are taken via our website or email [email protected], you will get a reply within 24 hours. On receipt of your email, we will confirm if there is availability on the course and advise of payment options. Course dates are not held unless a booking form and a deposit is received.

Course prices may be subject to change without notice and we reserve the right to reduce or increase course prices at any time. No refunds partial or in full will be given for courses booked by you that may later decrease in price, nor will we request you pay the difference for any courses you book that may later increase in price. We reserve the right to remove and add new courses to and from our schedule without prior warning. 

It is your responsibility to give us the correct contact information when you book a course. If we cannot contact you, we cannot be responsible for cancelled or missed courses. 

After you have booked and paid for a course you will be sent confirmation details relating to the course.

At present we are taking payments via BACS transfer, and PayPal.

We reserve the right to refuse admission to anyone or ask a student to leave the class should they present a risk to the business or is a disruption and prevents the rest of the class learning.

General terms

All designs & intellectual property rights remain the property of Confectionery and Training.

We reserve the right to use images of your cake for any form of advertising including web-based promotions, brochures or competitions. We advise you cake a copy of all documentation received from Confectionery and Training for your own benefit. This agreement together with the order confirmation documents provided constitutes the entire agreement and understanding between the parties relating to the orders except as may be expressly stated in this agreement. It supersedes and

cancels all prior agreements, statements, representations, understandings, negotiations and discussions whether oral or written between the parties. Each of the parties acknowledges and agrees that in entering into this agreement it does not rely on any statement, representation, warranty or understanding made prior to this agreement.
